A study of national green tribunal and its role in resolving the environmental disputes in India

Abstract: India is one of the members to the resolution adopted in 1972 at the Stockholm Conference i.e., United Nations Conference on the Human Environment (UNCHE) which was convened at Stockholm. India is amongst the few nations to have introduced an environmental tribunal after by enacting National Green Tribunal Act, 2010 which is popularly called as the ‘National Green Tribunal’ (NGT). The Green Tribunal is a fast-track judicial body established with the objective addressing the issues about the environment and related problems at the national level. A number of important environmental judgments have been delivered by the NGT since its constitution and indicated in India, the rising environmental and ecological concerns. The Green Tribunal is playing a very significant for achieving access to green justice in India. Thus, the Tribunal has been playing a vital role in resolving the environmental disputes in India by delivering leading rulings. This paper highlights the establishment and historical development of National Green Tribunal, its power and jurisdiction. This study also described the relation of High Courts vis-à-vis National Green Tribunal. It further attempt has been made to analysis a few leading judgments of the NGT in resolving environmental disputes in India.
