Surrogacy law in India: It’s implication on parentage

This paper analysis the implications for intended parents, surrogates, and the child delivered through surrogacy. It also examines the impact of the Surrogacy Act of 2021 on parentage.
One of the most intricate and contentious issues associated with this reproductive technology is the question of parentage in surrogacy. In order to establish legal parentage, it is necessary to navigate a complex web of laws that differ significantly from jurisdiction to jurisdiction, as well as to consider the right and responsibilities of all parties involved, including the surrogate, the intended parents, and, ultimately, the child.
